    The Liberty County Clerk's Office is open Monday through Friday from 8:00 A.M. to 5:00 P.M.

    We request that you fill out any necessary forms required for your transaction prior to visiting the office. Forms are available on this page on the bar labeled ONLINE FORMS below. Filling out a form alone will not complete your transaction. You will still need to come to the office and present identification to pick up your document. 

    Anyone needing to make a payment on a misdemeanor case should go to the Misdemeanor Docket section on this page and follow the instructions to make a payment to Official Payments, or may visit the office at the Courthouse and make a payment in person.

  • The Liberty County Clerk acts as the recorder and custodian of important public records in Liberty County--including all deeds and land instruments, bonds, birth and death certificates, assumed names, county plats, and livestock brands--ensuring that the records are maintained in a secure, archival manner. The County Clerk's Office also issues and records marriage licenses for Liberty County. The Liberty County Clerk serves as clerk of the court and custodian of records for the Liberty County Commissioners Court, the Constitutional Court (County Court), and the Statutorily-created County Courts at Law (1 and 2). The Liberty County Clerk is the elections official for Liberty County and administers the elections for the county.

     * The Liberty County Clerk and her deputies have no authority over, nor any influence on, the Courts this office serves. The County Clerk's Office is tasked with recording and filing all information provided to the office related to the hearings held, as well as bringing the files to the appropriate court when requested. The County Clerk position is administrative in nature, and does not make decisions on policy, spending, taxation, nor any of the day-to-day issues addressed by the Courts. Neither does the Liberty County Clerk or her deputies have any influence over elections or the candidates that run for elected office. The Elections Department is administrative in nature and must follow all federal, state, and local laws that apply to elections.

      The second conversion will affect the Case Management System used for all Misdemeanor, Probate and Civil Cases and the corresponding records handled by this office. Attorney access and public access will be available shortly.

  • Public Information Requests made according to the Texas Government Code, Section 552, may be submitted by accessing the Public Information Request Portal or by sending a request in writing to Liberty County Clerk, P. O. Box 369, Liberty, Texas 77575.

    Charges for copies of these records are required by state statute. Current fees are $1.00 per page. There may be a credit card service fee added. Certified copies are an additional $5.00 per document along with the $1.00 per page fee. Certified copies must be picked up in the County Clerk's Office. Documents may be viewed for free in the Liberty County Clerk's Office. Please call the County Clerk's Office at 936-336-4670 for additional information. 

  • The Texas Legislature recently amended the Property Code to provide a streamlined procedure for addressing discriminatory provisions in real property records. Although state law already declared restrictions and provisions in real property records that prohibit the use, sale or transfer of real property to a person based on race, color, religion, or national origin to be void and unenforceable, Senate Bill 30, which took effect on September 1, 2021, establishes a  process for a property owner, or another person that the owner authorizes, to request a judicial  review of specific property records to  determine whether they contain prohibited discriminatory provisions.

     

    The bill sets out the contents of the documents required to be submitted to the court as well as a suggested format for the court’s findings and order. Under certain circumstances, the court may issue its determination without conducting a hearing. No filing fees may be charged under the statute.

  • Ag/Cattle Marks and Brands

    The agricultural/cattle marks and brands renewal period has ended. All brands that were not renewed now have to be re-registered. Unregistered brands may be subject to appropriation, so re-register as soon as possible.

    We are proud to offer an alternative to coming into the office in person. We now offer an online application request program. (*Online applications for marriage licenses are not available yet. Marriage license applications must still be performed in our office.)

  • Assumed Name Certificates, or D.B.A.s

    A person must file a certificate with the County Clerk if the person regularly conducts business or renders a professional service in this state under an assumed name other than as a corporation, limited partnership, limited liability partnership, limited liability company, or foreign filing entity.

    A corporation, limited partnership, limited liability partnership, limited liability company, or foreign filing entity must file a certificate with the Texas Secretary of State if the entity: (1) regularly conducts business or renders professional services in this state under an assumed name; or (2) is required by law to use an assumed name in this state to conduct business or render professional services.

  • THE ADDITION OF A $15.00 FEE FOR ALTERNATIVE DISPUTE RESOLUTION TO ALL CIVIL AND PROBATE CASES FILED (WITH THE EXCEPTION OF CONDEMNATION/EMINENT DOMAIN AND MENTAL HEALTH CASES) WAS APPROVED BY THE LIBERTY COUNTY COMMISSIONERS COURT ON APRIL 27, 2021. THE FEES ARE EFFECTIVE BEGINNING MAY 1, 2021. THE CHANGES TO THE FEE SCHEDULE ARE POSTED BELOW.

     

    THE ADDITION OF THE COUNTY CLERK ARCHIVE FEE TO THE FEE SCHEDULE HAS INCREASED THE COST OF FILING DEEDS BY $10.00 FOR THE FIRST PAGE. IT IS NOW $26.00 FOR THE FIRST PAGE AND $4.00 FOR EACH ADDITIONAL PAGE. ANY DEEDS RECEIVED WITH INSUFFICIENT PAYMENT WILL BE RETURNED WITH A REQUEST FOR PROPER PAYMENT. OTHER FEES HAVE INCREASED AS WELL WITH THE NEW FEE. PLEASE VERIFY THE FEES IN THE SCHEDULE BELOW BEFORE MAILING IN YOUR PAYMENT. 

     

    WITH THE PASSAGE OF SENATE BILL 41 BY THE TEXAS LEGISLATURE IN 2021, ALL CIVIL AND PROBATE FILING FEES CHANGED. MOST CIVIL AND PROBATE FILING FEES HAVE INCREASED. PLEASE CHECK THE FEE SHEET LISTED BELOW BEFORE SUBMITTING A CASE.
